Canadian Power Of Attorney

Posted on November 4, 2010.
Canadian Power Of AttorneyIs a Canadian company to give a proxy to a notary public in the U.S.a

Sure.

With your additional details, all in New York notary fact is proving that the person who is Mexican, he says he is and he signed the documents and that, consequently, it has a proxy.

Yes

Of course, may make his share of business.

What do you meana

Are you saying that the Canadian company wants to give POA to a notary in the U.S.a Or tell you that Canada wants to have a notary in the U.S.a

Not sure about Canadian laws, but here in the States, it does not matter where the document, society, or a notary originates, provided that all legal requirements, registration requirements, etc. are met.

A corporation or a Canadian citizen can nominate whomever he wants as the proxy. Keep in mind though that the attorney and law firms are regulated at the provincial level and your lawyer may have other authority priveledge ... by province and now you're talking about a completely different country ... my simple opinion. .. talk to a lawyer.

OR ... ask yourself if you can name the prosecutor (ie sign the document) before a notary in the U.S. ... you can ... But again ... who wrote the documenta The document must be made in accordance with the laws of the province in which the corporation was formed.

Your question is somewhat obscure. The undersigned certifies normally only the identity of the person who signs a power of attorney notary shall be entitled to the place where the signature is affixed.

If the question is whether individuals or officials in Mexico accepts the authority of the Company to act is another matter. Local officials to determine what is acceptable. In general, the certification must be the highest authority in the home jurisdiction certifying corporate existence and corporate powers.

Mexico is a signatory to the 1951 Convention of The Hague on the certification that would allow certification by apostille your provincial authority of the corporate identity and authority. However, in my experience of many Mexican officials, lawyers and notaries have a minimal understanding of the law and I do not know exactly what you want to do. So I suggest you contact the person you're dealing with Mex and their lawyer contact your lawyer.
