I would seek legal counsel on this issue, but from what I experienced in Fl, purchasing spouse must be shown separately on the act, they should also indicate at least the separation agreement, This may not be sufficient to waive the spouse's interest in the property, I would ask advice from a lawyer about this. Regarding the mortgage goes, if it is to sign the joint statement notes, they are responsible and it is holding the sale of the property, refinancing or assumption of the loan for the down. Seperations are delicate, so seek legal counsel, the last thing you want is an ex-spouse having a claim to your property
