Onslow County Deeds

Posted on November 6, 2010.
Onslow County DeedsI need to have an ex refinance and transmit it to act. How do I do with little or no moneya

my ex-husbands wife will not refinance the house togrther bought more than 7 years. We need to get its name from the deed of loan and mortgage. with little or no money. Can anyone help me. It's in Jacksonville NC, Onslow County.
Thank you for your help ..

If he just wants out of this, he needs to make a claim Quit deed and record it at the county recorders office. After it is saved to send him a copy to the mortgage company and make them his name to the loan.

I just have an idea of what can be done since I am the same thing a few years ago. If a party does not cooperate with a request for refinancing, then you can make a "forced sale". You should do a little research on this subject in your state. People to ask are real estate agents. They will be able to do the research for you and help you through the process.

You'll have to petition the divorce court to have his respect.

You usually can not provide the name of a title. Is it simply refuse to refia If she refuses to refi and is a little life, it is probably a subprime borrower (without intent).

Here's how I know it's usually go. I am not a lawyer, but that's what I understand:

As to the mortgage company goes, they are both responsible. However, if a divorce decree giving it the sole obligation of the house, that would make him a liability to him on the issue. Therefore, if repo'd, the company would go after both, then he could go after her. This is called "joint and several liability" I believe. Could be useful for research on the net.

Maybe a lawyer or someone smart could confirm that for me!

I also agree with golfer to an extent ..... It is a violation of the divorce if she is not looking to sell. However, in some cases, the court take note of having to make a "good attempt to sell". They can not force what can not be done.
