I strongly recommend that you speak to a business advisor before making anything especially spend money. I'd call the local office of SCORE (go to http://www.score.org enter your zip code and find the chapter nearest you), the advice is free.
The SCORE counselor will most likely advise you to write a business plan that is very good advice because it forces you to dig all the information and start up costs of your small business and force you to also include all aspects of this enterprise, including customers, focus on (your market) and how you go after them.
You will need to register the business with the office of your state comptroller and make sure you are city and county licenses if any are needed where you live. All this comes in a business plan.
